Paddling on canals and rivers is a popular activity, but it can be dangerous. To ensure safety, it is essential to follow guidelines for safe and enjoyable canoeing. The Danube and River Rhine are international waterways, and permits are not required for canoeing on these rivers. However, in the UK, a license is required for canoeing, kayaking, or paddleboarding on many rivers and canals.

The SCA has condensed the relevant rights and responsibilities for canoeists in the Paddlers Access Code, which can be purchased individually or through Paddle UK membership. The World Triathlon has postponed the men’s individual triathlon race at the Paris 2024 Olympic Games due to poor water quality levels in the River Siene.

The U.S. Supreme Court has repeatedly ruled that rivers that are navigable are legally navigable. However, some areas like National Parks require permits, such as Dinosaur Monument and Canyonlands. The rules for kayaking on rivers vary state by state, and it is generally not necessary to have permission to kayak on a navigable river.

When canoeing on canals and rivers, everyone is welcome, but a small craft license is needed. If you are from Washington or Idaho, you don’t need a permit as long as you are no further than a mile off the Columbia River into Oregon. The real grey area regarding navigability is whether one can fish from the boat they are navigating.

Can you canoe up river?

If you travel downstream it’s very counter-intuitive since you have to paddle backwards to ferry across a river. In general, going upstream is not much of a problem, if you know how to read the water. Just as a reminder, make sure to wear safety equipment (life vests and tethers) so you minimize the risk of drowning.

What you’ll do most of the time when there isn’t much flow.

Moving between the relatively still/upstream flowing parts of the river – they usually occur around bends at the sides of the river, outcrops rock in the middle of the flow or sides or, at nodes in waves (and the like). You ferry-glide between these until you get where you want to. There’s a tome about it in another answer.

How do you know if a river is safe to kayak?

When a waterway is runnable, it is suitable for paddling. If water levels are above or below the recommended flow range, the trip is not recommended for paddling at the time.

Can you own part of a river in the US?

Riparian vs. Appropriative Rights. It is important to note that under Public Trust, water resources “belong” by the public; property owners can’t “own” water, but they may have the right to use, sell, or divert water resources, depending on the laws in the state. The two main types of rights are riparian and appropriative.

As a general rule of thumb, most states east of the Mississippi River use a system of riparian water rights based on English Common Law. This system grants a water right to property owners “whose land physically touches a river, pond, or lake.” The right is transferred when the land is sold and remains valid even if the right is never exercised and the water isn’t used.

Appropriative rights, on the other hand, allocate water based on historical usage, rather than land ownership. Rights are based on seniority, or “priority date,” and can be lost if they aren’t used on a regular basis. Senior rights holders are first in line and can use their allocation even if there isn’t enough left over for junior rights holders.

Is Riverbank private property?

The riverbed of a non-tidal river (i.e one which is inland and not affected by the tide) is presumed to be owned by the nearby landowners. If the river runs through a landowner’s land, that landowner will own the riverbed. Whereas if the river forms a boundary of a landowner’s land, that landowner will own the riverbed up to the centre of the river along the stretch of the river which forms their boundary, their neighbour owning the other half. Those owners of the river are known as “riparian owners”.

Again, these rules can be ignored if there is evidence showing the land is owned by someone else. For example, the deeds for the land may include the whole riverbed specifically, or the boundary may be marked by a brick wall or a fence instead of the river itself.

So called riparian owners, also have certain rights over the stretch of river they own.

Can you drink and kayak in NC?

North Carolina’s Boating and Alcohol Laws. Boating and alcohol consumption laws vary from state to state. According to North Carolina’s boating and alcohol laws, it is illegal to operate any boat (this includes motorized boats, personal watercraft, waterskis, sailboats, sailboards or other similar devices) while under the influence of an impairing substance, such as alcohol or drugs.

In North Carolina a person is considered to be under the influence/intoxicated if:

Are river banks public property in the US?

• Even though the U.S. Supreme Court has consistently held that flowing waters are public waters, states hold sway when deciding public access to the banks and bottoms of streams and rivers, because states have control over local property rights. It is the responsibility of each boater or angler to know the trespass laws in their state.

• Since water-rights laws in some jurisdictions seem ambiguous, an angler and landowner may not agree on what is legal access or not. If unclear and a conversation ensues, work to find an answer from the authorities. A better understanding of water rights by both parties and a pleasant conversation trumps confrontation any time. Does the landowner like to eat fish? We’ve seen where sharing a fish or two with a landowner can go along way to building cooperation and more pleasant trips to the river.

In 2021, Scott Miller, a 47-year-old nurse from Minneapolis, made his first attempt to break the record for paddling the entire 2,350-mile length of the Mississippi River. At the time, the fastest known time for completing the journey was 18 days, 4 hours and 51 minutes. But on May 21 of that year, near mile 2,200, after 16 days of paddling for 24 hours a day, his team’s boat sank in heavy waves just north of New Orleans. They’d come so far, and been so close to the finish line, only to fail. The result left a bitter taste in Miller’s mouth.

Two weeks later, Miller sat down with his crew chief, Michael “Moose” Dougherty, at an Irish bar in St. Paul, Minnesota. Over Guinnesses, Miller made his pitch: “I’m not going to beat around the bush,” he said. “I’m going again, and I need you to be crew chief.”

Dougherty suspected this was coming. Before driving to the bar he had planned to say no, and he even told his wife there was no way he could do another attempt. A Mississippi River paddle is a huge project, with many risks. And yet, Dougherty heard the words come out of his mouth like someone else was saying them: “Okay,” he told Miller. “I’ll do it.” They decided to plan for the spring of 2023.

With knowledge and the proper techniques, going upstream, in some situations, doesn’t use much more energy than going downstream.

It’s fun and a new challenge. With skill and practice, there can be great satisfaction in this game of hide and seek with the current. Once mastered, it opens up a new realm of possible trips.

Note: These techniques work best on meandering streams with mild to moderate current. On relatively straight, featureless streams, you’ll find fewer opportunities to avoid fighting the downstream current.
